EDITOR’S COMMENT: Thousands of homes are involved. Tens of thousands of lives disrupted or destroyed by the process of foreclosure that was at minimum, questionable. And what did the banks do with their ill-gotten gains? They either abandoned the homes because they were done with it and didn’t want to pay maintenance, insurance and taxes, or they are donated the homes to charities, which is just another way of abandoning the homes.

These events corroborate the premise of this blog: that the Banks are mere intermediaries who have no skin in the game, are claiming fictitious losses on behalf of fictitious creditors. This information should be used, along with as much other information as you can get from title and securitization chains. It would be particularly helpful in mediation and modification attempts.

On a statistical basis, it highly probable that a large percentage of these homes were the subject of a modification proposal by the homeowner. Under HAMP, the servicer is required to consider the proposal. The assumption was that the servicer would act in a reasonable manner — i.e., if it made more money on the modification than the foreclosure, it would accept the modification. That is the way real estate work-outs have gone for hundreds of years. Here we can assume that all such attempts at modifications were denied without consideration — and without telling the investors about it either. It is the final slap in the face of Americans whose tax dollars were used to bailout these monstrosities.


Forget collecting coins in a red kettle — charities are increasingly netting donated homes as a result of the foreclosure crisis.

And the trend is likely to to continue. USA Today reports that Bank of America donated 150 homes in 2011 and plans to donate more than 1,200 next year. Wells Fargo donated almost four times as many homes this year compared to last. And Habitat for Humanity almost doubled the number of donated homes that it’s rehabbed in the year ending last June.

“It’s a win, win, win” Rebecca Mairone, head of Bank of America’s donation program, told USA Today. Those three “wins” include one for the neighborhood where the house is located, one for the bank, and one for the investor.

By donating homes — typically of low value — owners rid themselves of a mortgage and the expenses that go with upkeep, as well as earn tax breaks for their donation. Depending on who the home is donated to, it might be torn down, refurbished or rebuilt completely.

In some places home donations are becoming too popular. reports that in Detroit, nearly 98 percent of homes offered are declined, as many are too rundown. And as home donation inquiries increase, some charities are still figuring out what they can and cannot accept.

“We had to kind of look at our policy on accepting house donations,” William Brazier, executive director of the Society of St. Vincent de Paul Detroit, told

But saying “no” to that many home donations still puts most nonprofit organizations and banks ahead of the game. Nonprofit News reports that Real Estate Donations, a division of the West Dundee, Ill.-based nonprofit Restoration America, is still taking advantage of the upward shift in donations.

  5. I would like to see the clear title that is given along with it. How can the give what they do not own? That is why they are giving and trying to get the deduction since in the future when it all washes out they will have to give back what they in fact did not own as the 14-15 homeowners in 2011 got when they won their case.

  6. What do those banks care. They look good…thats all that matters! It doesnt matter that they distroyed a family to get that home, they just got it. Wish one day that a Law Firm or attorney will have the guts to stand up to these banks. So far no one in Georgia that I have been told or contacted.

  7. The investros are not usually involved with the banks, other than having lines of credit with them.
    Investors who are buying these foreclosed properties and flipping them, are liable to the new owners through lawsuits, and they can hold title companies accountable if the right language is in the policy.
    Unfortunately, many title policy issuers have stopped warranty of title on foreclosed homes. In particular Chase and BOA properties are ineligible for title insurance, and you can probably guess why.

    Many investors are having a hard time getting owners who can qualify for and get loans to buy, so they are refurbing and renting out the homes. Any improvements investors, who will be temporary “owners’ at best make to the property will benefit the rightful owner when they reclaim it, if and when they do.

    I was an investor for a while, and I can tell you; many investors lost everything they owned. The only people who consistently made money were the ones selling investment courses and seminars, particularly commercial property where I was focusing.
    Upscale apartment communities can’t get renters when the rents are at market or below in adjacent properties, and many an apartment complex owner has gone bankrupt in the last four years. I get between 5-7 properties a day in my inbox, where the complex has gone into foreclosure and is 90% empty. These were huge money makers, that are now empty and in disrepair, going for $25,000 or less a unit.

WTF you can’t donate that which does not belong to you.This is just a tax write off for the banks,another way for them to get a break.It would be different if the titles were clear but thier not.So we will end up with a bigger mess because no one has made this right.Can you imagine a homeless family being given a house and then a few years later having it torn out from underneath them because the banks and charities are not doing thier job.We are just heading toward another big fiasco.

I, too, laugh yet am also sickened at the audacity of what is going on, and how the “PROFITEERS” think they have us American citizen Homeowners fooled! All they need do is read these comments on this one blog post to see how intelligent you all are! If Homeowners were 2 stand their ground en mass on this foreclosure fraud and financial fiasco, those that profit from foreclosure and securities fraud would not get too far. If ALL PARTIES who benefit from Fraud in Foreclosure-related actions would resurrect what shred of a conscience or humanity they still possess, refuse to participate (even if it meant losing their job or heaven-forbid, some of that I’ll-gotten-gain, or what I call “BLOOD MONEY” or “DIRTY MONEY”), and become whistle blowers, I don’t think this could go on much longer as it is.   10. The Banks don’t own the properties, so how can they donate them? Even if they could, they should ‘donate’ the homes to the first-in-line priority…the families they stole the homes from!!!

    Neil, I’ve been trying to contact you re my US DOT matter involving HAMP, the trust purporting to own my loan, the private ‘Delaware Statutory Trust’ that claims to ‘administer’ the trust, the special Rules tbese Statutory Trusts use to evade registration with the SEC (Rule 118-A and Regulation D), the “Private” Trustee, the “Public” Trustee, “MICRO-trusts”, quarantine of “toxic assets” away from good assets, etc etc. I’m Pro Se in CA.     What affect does a donated house have on a person trying to get it back fighting the fraudclosure? Does it make it more difficult? It would seem to me that because “no 3rd party” actually purchased it and no money transaction occurred, how can any burden of hardship be placed on the charity in getting the house back?

    No Charity will own it. Sure, they may put people in it and maintain the property but a simple title search will still show a different ‘true’ owner.

    Unless there is some way the OCC settlement (now) or the Bank of America settlement where those homeowners may decide to cash that check for less than $1000 is a new contract of release from liability since a ‘settlement is accepted’.

    They haven’t given anything away, and they are certainly not outside the process.

    They are just moving the ball from under one cup (bank) to another cup (charity) on the same table. The ball belongs to the original owner until they get a signature, ‘hook or crook’ from that homeowner.

  22. I am wondering about the investors who buy foreclosed homes and then flip them. Are they connected with the banks in any way where as the bank will help them purchase the property while they are occupied and get a percentage from the sale? The investor who purchased our property paid 260,000.00 for it and is now selling it for 360,000.00 the sale price was our loan amount. I would be interested in finding out a connection between the bank and the investor.

    I have not forgotten you, nor anyone else that made contact with me. The one attorney I am using is buried. The other one is in Austin and he and I are playing phone tag. The other attorneys that I was promised access to by a Forensic Auditer has yet to materialize, and I have called him repeatedly. I am starting to think he was bluffing or something has happened.

    When I initially hired my attorney, I thought he would be chomping at the bits for good clients that were in the same situation as I am with a known robo signer. I offered to screen clients for him and do the initial case research to even see if they were viable clients by checking to see if they had a Robo Signer and if that Robo signer had already been deposed. He turned me down and said that he was not in need of new clients and is looking to retire by the end of the year.

    He has a rather small firm that employs a few other lawyers and I also inquired if any of them would perhaps be interested in carrying on his “legacy” so to speak. He responded that they do criminal and civil law, but none of them were “real estate or foreclosure” experts and had no desire to become one.

    I will continue to check periodically and if anything changes or I hear of someone else, please know that I will be on this forum posting their information IMMEDIATELY. We are all in the same boat together and a victory for one of us is a victory for all of us. And I am praying for ALL of us.

If foreclosed homeowner sues and case goes to court, the judge and jury surely wouldn’t want to harm the “do-gooder” charity and rule against them.   29. It may be a win-win-win for the banks, neighborhood and investors, but they forgot to mention that it is a LOSE-LOSE-LOSE for the family that lived there and all those that have been affected by the securitization scam including the investment funds that paid for those homes.

  30. Mr. Chairman, a serious situation confronts the House of Representatives to-day. We are trustees of the people and the rights of the people are being taken away from them. Through the Federal Reserve Board and the Federal Reserve banks, the people are losing the rights guaranteed to them by the Constitution. Their property has been taken from them without due process of law. Mr. Chairman, common decency requires us to examine the public accounts of the Government and see what crimes against the public welfare have and are being committed.

    What is needed here is a return to the Constitution of the United States. We need to have a complete divorce of Bank and State. The old struggle that was fought out here in Jackson’s day must be fought over again. The independent United States Treasury should be re-established and the Government should keep its own money under lock and key in the building the people provided for that purpose. Asset currency, the device of the swindler, should be done away with.

    The Government should buy gold and issue United States currency on it. The business of the independent bankers should be restored to them. The State banking systems should be freed from coercion The Federal Reserve districts should be abolished and the State boundaries should be respected. Bank reserves should be kept within the borders of the States whose people own them, and this reserve money of the people should be protected so that the international bankers and acceptance bankers and discount dealers can not draw it away from them. The exchanges should be closed while we are putting our financial affairs in order.

    The Federal Reserve act should be repealed and the Federal Reserve banks, having violated their charters, should be liquidated immediately. Faithless Government officers who have violated their oaths of office should be impeached and brought to trial.

    Unless this is done by us, I predict that the American people, outraged, robbed, pillaged, insulted, and betrayed as they are in their own land, will rise in their wrath and send a President here who will sweep the money changers out of the temple.

    Regarding Banks donating foreclosed houses that were homes to many familes, we could have avoided all this pain and trauma if the the banks had just a BIT of COMPASSION. The Loan Mod program could have worked if greed and profit were not so necessary for the Banking industry and the ole wise ones making these decisions for the benefit of our country. I hope these CEO’s and politicians are learning what not to do in the future.

    Steal peoples’ homes, throw them out, then donate them to charities.
    So much for loan modifications and keeping people in their homes.
    The shelters are full while the homes are being mowed down.

    I’ll just bet the banks, in their hurries to foreclose, never bothered to consider the condition of the homes
    before or after they foreclosed. Then later they saw where so many homes were in disrepair
    due to general vandalism and decline of the neighborhood from so many evictions and abandonment
    that they could not be auctioned off or were too expensive to repair.
    Thus, more money to be had by tax write-offs.

    This is what I mean. People are so concerned about making their payments
    and these banks could care less about people, though their advertisements suck you in
    with their pictures of the happy families fulfilling the American dream of home ownership
    that only they can make possible for you because they care so much about your future.
    (until you miss a payment).

    It would not surprise me if the banks have a stake in the charities, too.

Essentially taking from the middle class and giving to the poorer class, creating a larger poorer class of Americans, and creating more of a gap between the elite and the poor class of Americans.
