Next Tuesday, November 1, 2011, Valerie Edwards an attorney – partner with Koeller, Nebeker, Carlson Haluck LLP will join us.  Ms. Edwards Valerie Edwards with Koeller, Nebeker, Carlson Haluck LLP is one of the key attorneys working on the MERS Multi-District Ligitation case in which all plaintiffs were eventually dismissed with prejudice.  The last of the dismissals were summarily processed by Judge Tielborg.  Ms. Edwards will be giving us an overview of the proceedings and filling us in on an appeal which is scheduled to be filed prior to November 1st.

You can capture the essence of the bill’s adaptations of the SB1259 efforts just by looking at the highlights on pages 1 and 2 of the attached pdf. The interesting thing about this bill is that Nevada’’s legislature essentially poured the last proposed SB1474 amendment (formerly SB1259, See attached Word document) into their legislation. Nevada graciously adopted the concept that it is the Trustee that needs to be held to account as they are being the unaccountable heavies for the mercurial foreclosing entities.

Nevada Assembly Bill 284 was introduced in Nevada on March 15, 2011 and enacted into Nevada state law on October 01, 2011.

Contrary to the post-mortem soliloquy made on the House floor about Arizona never seeing another loan from a bank if SB1474 had been amended, Nevada has not suffered any published adverse repercussions from the enactment of NV AB284 to date.

The goal of our legislative effort is to give the tens of thousands of Arizonans who are facing difficult times the opportunity to hold to account the foreclosing entities who are so brazenly flaunting Arizona’s foreclosure statutes. (Not to mention the abuse we are suffering in court. But that’s an argument for a different arena unless our legislators are willing to step up and make a needed change in the election laws for state judges.)

Additionally, as a result of published accounts of Arizona’s grass roots efforts on SB1259, a group of Hawaiian homeowners was able to directly help Hawaii enact some very appropriate legislation in their last session.     I had the same impression and, for a minute there, I thought it was me. Once again, that new and improved HAMP is for people who are… current!!! And it is optional for banks to participate (although I understand the bribes will be better this year).

    That’s why so many of us stop paying, get an attorney and SUE. Only way to get anything in this darn country.

  2. I guess I should have taken the blue pill, then maybe I’d be completely in the dark about all of the bullshit being peddled out of D.C. If you look at the original HARP site, you’ll see that there’s absolutely no difference in the program that’s been running since March 2009, save for a higher LTV’s, and there’s no longer a need for a physical appraisal.

    Let’s think about these changes just for a moment. No meaningful LTV. Check. No accurate appraisal. Check. TBTF still TBTF. Check. We’ve come a long way since 2008. Uncheck.

    This is the same old garbage, different year. Not to mention that the original HARP, which we all know was a total failure, is shown as running through June 30, 2012, so why all the fanfare, save for fooling some dumbass voters into believing that Obama has finally done something….about anything.

    According to the FHFA director, there’s no expanded eligibility….which makes this program simply a come on. This FHFA guy directing this crap has the nads to publically estimate that it will save the average dupe around $26 per month on their mortgage payment. That will go a short way towards staving off the guaranteed starvation about to grab this very same demographic when we all run out of money together at the very same moment. I wonder if bankers taste like chicken?

    But here’s the kicker people, spelled out very clearly:

    The HARP loan is a new loan and will require a loan application and underwriting process.

    I hear the ching-ching that only chings when a banker gets his greed on. The evil-doers behind this HARP scam might as well say, “To write these mortgages anew, saving homeowners tens of dollars while scripting new chains of title for the beleaguered banking industry is a great thing for our economy.” Read: bonuses all around boys.

    Obama’s next program addressing the moral hazard dilemma will be Certifying Responsibility And Punctuality, followed by his last program attempt, just before the collapse of civilization entitled, Foreclosing Underwater Borrowers As Retaliation, a bank lobby designed program.

    Are they even talking about presidential politics?

    “Not really. Maybe some are,” Smith said. “But they’ve lost so much hope in what Washington can do. They are so turned off by the posturing, the bickering, the partisanship, that it’s not even worth talking about.”

  14. BSE: I don’t know if she is the real deal or not. I corresponded with her privately several times about a year ago. She seemed sincere, genuine and in sympathy with homeowners’ plights. But then she had some dealings with Nancy McLain and I don’t know what went on there, but Reagan ended up dropping the deal. On the video it looked like McLain (the bankster’s tool) threatened Reagan.

    Then Carl Seel sold out the homeowners and got himself a modification with a principal reduction. A month later Michele settled with her servicer – coincidence?

    I’d like to believe that Michele is the “real deal”, but her behavior is rather odd. I must also remember the old adage about never relying on a politician to be anyone’s savior. Here is mandelman’s take on the situation:
