Many homeowners have been asking me about litigation solicitations they receive in the mail.  Most of these solicitations invite you to invite join a litigation already in process.  BEWARE!  Here are my thoughts.

I think they should be treated as an attempt to defraud you in one way or another.  Here’s how I’d handle these invitations.

Throw the invitation away and forget about them.
If you must call them
Don’t reveal your phone number:
Call from someone else’s phone or a payphone
Block your phone number
Use the *67 feature before you dial
Don’t reveal
Your name
Your location
Any information from the litigation invitation
It will be used to track you
“I don’t have the card in front of me.”
Immediately DEMAND:
Name of person you are talking to
Authority of person
Person’s ID number
Person’s direct phone number and extension
Their company information
Mailing address
Case venue
Case number
Court stamped copy of the court filed Complaint
Tell them you must read it before proceeding
Copy of solicitor’s contractual agreement with attorney firm
Attorney contact information
Attorney name
Attorney firm name
Phone numbers
Bar membership information
Tell them you will get back to them
“after I have my attorney review your information”
If you feel they have given you access to sufficient information and you’re somehow convinced that they are legitimate – PROCEED AT YOUR OWN RISK
Still don’t give your personal information!
Read everything
Have everything reviewed by a trusted advisor
Only sign something you understand

If things turn out to be not as promised
Contact the Arizona Attorney General and file a complaint

  1. I enjoy your website, and have a question, I’m hoping you can advice a PHX area attorney,

    I’ve been struggling with a Country Wide/BofA home loan set up in 2008.

    After conducting a 3rd party Audit, we discovered TILA violations and underwriting violations, including predatory lending practices.

    I’ve already written to BofA to Request for a Rescission due to Federal Law Violations on Aug 16, 2011 and expect BofA will send the usual standardized form letter, as they have done the past 2 years.

    If you know a good PHX/Scottsdale attorney, I would really appreciate your advice.
