COCHRANE ENTERS WELLS FARGO DATA AND CONTACTS

I ran a report of Wells Fargo Bank, National Association, Sioux Falls SD to see that part of organization as related to the refinancing date of my mortgage.

The ‘Originator’ was and employee of Wells Fargo Home Mortgage employees of a storefront in NJ. Are they really employees of a national bank because Wells Fargo Home Mortgage, Inc. merged out of existence? Would that include all of the former names? Norwest Mortgage? GMAC Mortgage Corp? BANCO Mortgage? Directors Mortgage Loan? and in the agreements of the securities you’ll find the bank names that belong to Wells Fargo & Co. parent, marketed as Wells Fargo Bank NA. Why are we not protected from deceptive advertising regarding financial products and financial services placed into the public domain for consumer consumption? That means we would be protected by the FTC but we are not when it comes to banks. Why not when the banks used the names to mask the fact they took consumer credit application into a secret pipeline and sold loans at a discount. We were so stupid.

Why was the Cease & Decisit issued? Will it be just the 2009 foreclosues forward that are to be reviewed if they were processed lawfully? What about before 2009?

If you are not familiar with the ffiec.gov you can pull up entities and figure out when and what name they use to operate under and if they are part of the Federal Reserve System. If not, who then was the bank you did business with? They have thousands of affiliates, brokers, dealers, agents, distributors, wholesale and retail who do business with you under the name of Wells Fargo Bank NA or take your deals to them.

    Business agreements are perpetual and American’s don’t understand how trade names are private brand labels masking who they are doing business with.     How many of the foreclouses in the name of GMAC or Norwest or BANCO or Nationsbank or Countrywide or INDY Mac or One West have just been part of Wells Fargo & Co/MN? Is that unlawful? Not according to the agreements.

    Substantive omissions of material facts, deceptive acts, concealment, etc…. Now that is another matter. And the ‘Who’ starting with former President Clinton destroyed the levey.

    Holding companies allow the reduction of risk for the owners and can allow the ownership and control of a number of different companies. In the U.S., 80% or more of stock, in voting and value, must be owned before tax consolidation benefits such as tax-free dividends can be claimed.[1]

    Sometimes a company intended to be a pure holding company identifies itself as such by adding “Holdings” or “(Holdings)” to its name, as in Sears Holdings.

    Wells Fargo & Co. is the parent as far as reporting money through the organization.

    What is a Parent Company?
    Parent company owns enough voting stock in another firm (subsidiary) to control management and operations by influencing or electing its board of directors.

    A parent company could simply be a company that wholly owns another company. This would be known as a “wholly owned subsidiary.”

    A lone company may not be called a subsidiary of any organization.

    The parent company does ot have to be larger or more powerful entity. The parent company may be smaller than a subsidairy, and do not have to operate in the same locations, or the same businesses and conceivable could be competitors in the markeplace!

    Note: Because a parent company and a subsidiary are separate entities, it is entirely possible for one of them to be involved in legal proceedings, bankruptcy, tax delinquency, indictment and/or under investigation, while the other is not!

    The most common way that control of a subsidiary is achieved is through ownership of shares in the subsidiary of the parent. The shares give the parent control.

    A subsidiary may itself have subsidiaries.

    For example, Wells Fargo & Co. is a parent and all of its subsidiaries together are called a group. Group can also apply to cooperating companies and their subsidiareis with varying degress of shared ownership.

    Subsidairies are separate, distintct legal entities for the purposes of taxation and regulation. For this reason they differ from division, which are businesses fully integrated within the main company, and not legally or otherwise distinct from the main company.

    A non-operating subsidairy would exist on paper only (i,.e. stocks, bonds, articles of incorporation) and would use the identy and rolling stock of the parent company.

    Control of subsidiary generally includes both practical and theoretical control and of course is defined in the agreements.

    DTCC is the ‘holding company’ for DTC (1973) and NSCC (1976).

    And you thought the $23 trillion in backstops for the financial system was bad, you ain’t seen nothing yet. Earlier today, the Depository Trust & Clearing Corporation, best known for its Cede & Co. partnership nominee which is the holder of virtually every single physical stock certificate in the known universe, and accounts for over $2 quadrillion in stock transactions per year, announced that “the Federal Reserve Board had approved its application to establish a DTCC subsidiary that is a member of the Federal Reserve System to operate the Trade Information Warehouse (Warehouse) for over the-counter (OTC) credit derivatives.” With this approval the DTCC is now the de facto legally accepted global repository for over-the-counter credit derivative transactions. Simply said, the Federal Reserve is now the guarantor behind all CDS transactions that clear via DTCC, which would be pretty much all of them (sorry CME, you lose). The total bottom line in terms of gross notional? 2.3 million contracts with a gross notional value of $25.5 trillion. When the next AIG implodes, and the CDS market is once again facing annihilation in the face, who will be on the hook? You dear taxpayer, that’s who.

    The new Fed-endorsed organization will settle CDS obligations in all currencies and process credit events. It will also include all OTC credit derivatives traded worldwide, and will be regulated by the Fed and the NY State Banking Department and will be overseen by other US and International regulators.

    To be sure, the net notional CDS amount, which is what counterparties would be on the hook for in the case of an orderly unwind of the financial system, is materially lower than the gross total. Yet, as systemic unwinds are never orderly, gross tends to become net in those occasions when Lehman bonds go from par to 10 cents in the span of 24 hours. Should systemic risk flare up again (and this time Europe will be both shaken and stirred, thank you Mr. Hazard… Moral Hazard), and fiat-based market values quickly catch up with fair values (which in our ponzi economy can easily be calculated: they are all zero).

    The actual organization that will soon be in need of a bailout, is the Warehouse Trust (there’s that word again) Company, which in turn will operate the DTCC’s Trade Information Warehouse, and will begin operations “once certain organizational conditions have been met, which are expected shortly.” Presumably, the TIW, which has been in operation for just over one year, is somehow supposed to inspire confidence that the DTCC has an idea of everything that goes on in the quadrillion + CDS Market. “The release of this information has been an important step forward in helping increase transparency in the marketplace. More detailed information on individual firm trading has been made available confidentially to regulators around the world with the consent of market participants.” Oh great, at least someone has information to the confidential information.

    What all this implies is that basis spreads will likely compress very shortly, once counterparty risk becomes a thing of the past and all systemic risk in the biggest derivative market out there (ex IR swaps) is fully backstopped by the Federal Reserve. It will also guarantee the DTCC monopoly status when it comes to CDS trading as nobody will desire to transact and/or clear elsewhere.

    We shudder to think if the Fed grants DTCC with exclusive status for IR and FX swaps as well, and the associated $600 trillion notional outstanding.

    And from an insider, we know that the company will be funded and commence operations by March 1.

    Looks like they are merely completing their plans to transfer all the risk they created to the citizens of the United States of America through any and all avenues possible.

    October 22, publically during Foreclosue Gate Blitz, both CEO & CFO on behalf of Wells Fargo & Co. in their official capacity did share the following:

    Wells Fargo CEO John Stumpf: “We did not and do not plan to initiate a foreclosure moratorium.”
    Wells Fargo hasn’t been shielded from scrutiny over its foreclosure practices, but has said repeatedly that it does everything above-board – from delinquency notices to workout attempts to signatures on the foreclosure documents. Wells has staunchly rejected the idea that it should implement foreclosure freezes like other big bank competitors have.
    During a conference call on Wednesday, CFO Howard Atkins indicated that Wells has been more careful than competitors in handling foreclosures: “Our process specifies that affidavit signers and reviewers are the same team member, not different people, and affidavits are properly notarized. Not all banks in our understanding do it this way.”
    Stumpf was asked about a case that’s received widespread attention in which a Wells employee admitted to signing off on paperwork that others had reviewed in a court deposition. Stumpf pointed out that the judge still found in Wells Fargo’s favor and suggested that one bad apple hadn’t infected the entire tree: “Humans do make errors, but that is what our process is – one reviewer, one signer, same person.”

    “Interagency Review of Foreclosure Policies and Practices Federal Reserve System
    Office of the Comptroller of the Currency
    Offi ce of Thrift Supervision” — April 2011.

    From page 2 — quote:

    “The file reviews did not include a complete analysis of the payment history of each loan prior to foreclosure or potential mortgage-servicing issues outside of the foreclosure process. Accordingly, examiners may not have uncovered cases of misapplied payments or unreasonable fees, particularly when these actions occurred prior to the default that led to the foreclosure action.”

    Well — okay — so borrowers put in default before they defaulted. What does that mean??? It means that the current foreclosure claimant is FALSE — and, that your your loan collection rights were sold elsewhere — before you even defaulted.

    May very well be likely that ALL subprime loans were in default before default actually occurred. Thus, the basis for loan origination fraud and foreclosure fraud. And, the basis for securities fraud by the very debt buyers who purchased mezzanine tranches (and derivatives) to securitizations that were nothing more than false securitization of collection rights — that had no CASH FLOW receivable for a valid securitization.

    But, on and on we go — with little attack on the very fundamentals of a system that was set-up to defraud the people.

    Look, either we have parties that are trying to benefit from the fraud — or others that are just ignoring a system that went haywire and wild — without regulation or control.

    And, just try to get “back” documents. Gone — destroyed.

    Need more focus here — on what REALLY went on.

    If your loan was fraudulent from onset — or fraudulently in default before you even defaulted — we have HUGE issues — possibly criminal – but, again, where are the documents? Iron Mountain?

    Very frustrating to see that — after all this time — fundamentals are still ignored.

    Excuse me OCC you need to update and incorporate the list of robo-law mills who are paid bonuses and incentives by the banks – Read The Summit Newsletters and list of participating robo-signers.

    OCC said they included Lender Processing Services LPS and other default-service providers and MERSCORP and its wholly owned subsidairy Mortgage Electronci Restirction Systems INc..

    OCC says their examiners assessed the accuracy of foreclosue-related documentation including note endorsements and the assignment of mortgages and deeds of trust and loan document control.(3)

    (Footnote 3) For purposes of this report, default management services generally include administrative support and services provided to the services by third-party vendors to manage and perform the tasks associated with foreclosues.

    So the OCC and FRB claim to have looked at the documents and them fess up in the footnote they are only looking at the procedures of the servicer meaning Wells Fargo Ventures LLC?

    No I’m sure SERVICER means Wells FArgo Bank, National Association Sioux Falls SD. But then why when myh complaint under Congressional Inquiry with the OCC #854370 and about 50 others were handled directly by Bonnie Schooler, Janice Turner, Kristi Blue of Wells Fargo (something) in Des Moines Iowa?

    Take the fact that Wells Fargo Home Mortgage, Inc. in CA was renamed from another entity name which incorporates what? And affects merging out of existence ‘poof’ and gone ‘what’ into Wells Fargo Bank, National Association, Sioux Falls SD.

    We can see two examples where Wells Fargo Ventures LLC is the Managing member of entities doing business in FL selling residential mortgages that is part of the ‘Mortgage Corporation’ that the OCC was suppose to be supervising. Did they?

    Lets see in the report what the OCC would be looking at regarding:

    Bank of America, Citibank, HSBC, JPMorgan Chase, MetLife Bank, PNC, U.S. Bank, and Wells Fargo.

Reveiw teams independntly selected foreclosue file samples based on pre-established criteria (such as files for which consumer complaitns had been raised, or those in geographic areas with high volumes of foreclosues) with the balance of the files selected based on examiner judgment.

    Agencies conducted foreclouse-processing reviews at AllyBank/GMAC which is GMAC Mortgage of Iowa which was Norwest Mortgage, BANCO Mortgage?

    Anyway Aurora Bank well what does Aurora Bank FSB fka Lehman Brothers Bank FSB have to do with it when their dedicated Master SERVICER is Aurora Loan Financial LLC and used as a private brand label for servicers. WikiCorporation clearly disclosues Aurora Loan Finanical LLC only deals with Lehman Commodities. That means there is an Agreement for all transactions between Aurora Loan Financial LLc and Lehman Commodities to use Aurora Loan Services LLC as the name? Or Wells Fargo Bank NA in Agreement with Wells Fargo Asset Managment Corporation does all business in name of Wells FArgo Bank NA LENDER or TRUSTEE. As LENDER are they Wells Fargo Ventures LLC? dba PNC Financial or Pinnacle Mortgage of NV or Security First….

    The OCC reviews included mortgage-servicing activities conducted by insured banks and thrifts, as well as by several nonbank affilaites of these organizaqtions.

    I have a very good question. If the OCC can only look at the banks for example Aurora Bank FSB and Wells Fargo Bank, National Association Sioux Falls SD, how will they see the documents I’ve seen that reveal the frauds?

    For example, the Cashier’s Check Deutsche Bank Trust of Americas, DBT Co LTD of NJ check issued to an individual attorney who is the agent and partner of the Title & Settlement Company. The funding check from the BUYER of the loan, an intermediary funder, deposited into the Corporate Securities Treasury the funding payable to the attorney as an individual. So the evidence documents are not at Wells Fargo Bank, National Assocaition. The foreclosue complaint is handled by a Trustee under a Reconstituted Servicing Agreement in my case. So the OCC would not see at US Bank the Trustee foreclosing for the Loan Trust the documents. For Petes Sake the PRETENDER LENDERS can’t bring the NOTE into court so how can the OCC evey see what documents? to examine procedures?

    Adequacy of controls and governance over servicers.

    Does the OCC know who the servicers are? What is a servicer to the OCC? Where is the Agreement and definition?

I want to say something about my court case and how Chase automatically granted me and my Attorney an extra 60 plus days, no trustee sale, date was 4/28, without going to court in the morning for a TRO. Seems they didn’t want the publicity because my amended complaint was based on securitization and loan audit. So Happy – .

    The Notice of Default is gone on the two year old fraud thefts (not foreclosures…have to be the creditor to foreclose).

    The Notice of Default is only filed.
    You can’t get a certified copy of it from the courthouse; even if you wanted to. It’s just a piece of paper sitting there, you can get a copy, but it carries only the weight of how long it is kept there for them to do what they want to ‘steal’ the home.

    It gives them time to record documents, that couldn’t otherwise be recorded. Those recorded documents are used to ‘steal’ the home, and convey the title from trustee to trustee, etc.

    After a period of time, the useless piece of paper called the Notice of Default, has no place to stay. So it is destroyed by the courthouse that held it for whoever placed it there.

    Only thing left is the documents that used it’s existence to be recorded as if there was a legitimate transaction.

    Problem is. Without that ‘missing link’, there is no link from the previous standing of the homeowner and their mortgage contract to the conveying of the title to other entities.

    See the Mortgage has the signature of the homeowner, establishing that contract. All the other paperwork are unilateral contracts of people who use the county clerks office to record documents that are not ‘trust’ agreements, and are not ‘valid contracts’ – there are not two signatures indication an agreement of the parties.

    So whoever records an Appointment – to take over the role as Trustee over a Deed of Trust, really has only their signature indicating a right to do so. With no underlying contract, it’s a fraud recording, and it’s a permanent record.

    The Notice of Default was sooooo temporary but it was the key document that was placed in the public to give the appearance of a right that didn’t exist.

    Rather than let the court destroy it after a period of time; I put the document in my answer to the court. When I stated in that answer the Plaintiff was suing the wrong party.

    It’s been 10 days since I asked that court in writing for a copy of that case. They said they’ll call me. They say the case is pretty big. It will take time to copy it. Ah…yeah. I have no control over whether they will give me a copy or not – They sent a man-with-a-gun to make me leave my-property, I sure don’t have any control over getting a copy of the case that lead to my ‘dispossession’.

    I’m proud of the One who made this list, BUT, I don’t know what it means.

    116 –* PNC MORTGAGE, LLC (3382471) 58 FAIRFAX VA Domestic Entity Other

    is of interest. They have a Consent Order, not a Cease and Desist Order, and that Consent Order is for the homes that had been in foreclosure or foreclosed but not sold by January 2009 – December 2010. No mention of what’s in 2011, as if they’ve stopped securitizing (who would buy it anyway?)

    Formal enforcement against eight servicers:
    Bank of America, Citibank, HSBC, JPMorgan Chase, MetLife Bank, PNC, U.S. Bank, and Wells Fargo.

  24. Foreclosures that have been idle for 2 years are being sold off left and right. Looks like the Banks want to wash their hands of any filth.
