Fannie, Freddie Take Loan Files From Florida Law Firm


Fannie Mae and Freddie Mac have terminated their relationships with a top Florida foreclosure law firm and began taking possession of loan files on Monday afternoon from the firm, which processes evictions on behalf of the mortgage-finance giants.

Fannie and Freddie had previously suspended all foreclosures that had been referred to the law offices of David J. Stern in Plantation, Fla., a suburb of Fort Lauderdale.

Freddie Mac took the rare step of removing loan files after an internal review raised “concerns about some of the practices at the Stern firm,” a Freddie spokeswoman said.

“We have begun taking possessions of all files on Freddie Mac mortgages simply to protect our interest in those loans as well as those of the borrowers,” the Freddie spokeswoman said. A Fannie spokeswoman declined to elaborate.

Fannie and Freddie said they will move those files to other law firms in the state but that they hadn’t yet identified where they would be redistributed. The firms said they had notified Florida’s attorney general about the decision to remove the files and that the Stern firm had cooperated with the action.

A lawyer for Mr. Stern didn’t immediately respond to inquiries.

Barrett Burke Wilson Castle Daffin Frappier, MidFirst Bank, Midland Mortgage, Attorney Steven Leyh, Leyh and Payne committed FRAUD UPON THE COURT at the Galveston County 405th Court in 2009. 2 never before seen unsigned, ambigious settlement agreements were filed that we never saw or agreed to. Leyh lied to the Court that we saw and agreed to accept the defendants $40,000 and sign the SA, which include the re-payment of our 2000 FHA/HUD discharged debt. The debt was discharged and BBWCDF had the stay lifted in 96″, but they never took posession of the property. The debt remains in our name. We filed a lawsuit on all of them. But Judge Wayne Mallia entered judgment against us, that we accept the $40,000 and sign the settlement agreement, which include the discharged mortgage FHA/HUD debt. There is a 2000 discharged order, but what good is it? 1995 we filed chapter 13, we were both injured at work and 15 years later we are being hounded to death by criminals, that is in a class all by themselves. Our case is on Appeal, pro se at the 14th Court of Appeals and the 5th Circuit Court of Appeals. There was no due process, depivation of our 14th amendment right. This is unheard of, we trusted the judicial system. We are both disabled and almost 60, we were about 45 when we filed in 95″. The court would not allow our attorney to take the case to trial, so he and attorney Leyh signed an invalid, unauthorized, 1 page Rule 11 agreement that did not conform to the Texas Rule of Civil Procedure 11. So the court issued a judgment against us to accept the money, sign the SA, which include the re-payment of the 2000 discharged debt or we could face jail/fine. The case is set for submission, January 4, 2011, at the 14th Court, (14-09-01036-CV)-(Tr. Court Case 08CV0102).     I was told today that the office of Rhode Islands Attorney General will not be investigating Allegation of Mortgage Fraud by Robo-Signers in which they told the press they were on board and we have proof of wrongdoing on Mortgage Assignments and Affadavits that will prove that these recordings have robo wriiten all over them yet now the Attorney Generals office Heather McLaughlin Director of Consumer Unit announces that they are to busy to investigate fraud committed on our citizens of Rhode Island! Shame on all of you as you are lucky to be that busy as thousands of Rhode Islanders would be willing to take your jobs that are losing their homes daily in a state that is non-judicial and can take peoples homes without even a court hearing.

  14. Fannie is just distancing itself from the big, bad foreclosure mill. Don’t worry. They are in bed with other foreclosure mills. The cockroaches are starting to run when you turn on the light. It is all going to come out. I can’t wait for this robo election to be over. More of the same. We have to do something about it. I guess at the moment that means harassing your reps and the white house with E-mails and phone calls. Just seems kinda inadequate. We need something more substantial. Did they really think that millions of foreclosures would just disappear and everything would be just the same–destroying the middle class. Without the middle class, the whole house of cards comes down. You can’t shoot the golden goose.

  16. Wells Fargo repo’d a Tacoma woman’s car even though she had clear title. She called the cops, showed them the title, and they still wouldn’t do anything. The local reporter said they’ve heard of several similar reports.

    These guys are completely out of control. Take your car, take your home, reduce your FICO to single digits, and use up your tank of gas in the theft as well. Disgusting. They’re revolting, and we should be too.

  17. They have taken these files to “Protect their interest” what interest? the files are full of forgeries! To give to other law firms? I do not get what the they think they can change, the damage is done, you cannot “create” more fraudulent paper. Glad to see the mill went down, more have too, but I would be leary of their intentions here.

  18. Here’s a great read written by Bill Black’s co-author of the Huffpo piece, L. Randall Wray. Pretty much says the same thing, but is a must read and should be sent to everyone you know who doubts your rant about this stuff. This guy is pedigreed, and his solutions are right on the money.

    This MUST be sent to the POTUS, and every single government official you can think of. This is the only acceptable plan for a real fix that I’ve read. Don’t ask politely, those days are long gone. DEMAND that your president pay attention to these pundits, and stop listening to Wall street, the idiots who caused this whole debacle.

    And don’t wait to send this to your politician list, as Obama has geared up his “throw the deadbeats under the bus” campaign even further. It is painfully obvious that his masters at GS and JPM and others are pushing him hard, as there isn’t a single bit of concern coming out of this administration that the rampant fraud we’re witnessing is anything to be concerned about. On the contrary, the under the bus deadbeat toss appears to be speeding up.

    “The mortgages that back a Fannie Mae MBS are held in a trust on behalf of Fannie Mae MBS investors and are not Fannie Mae assets.”

    That must be what they mean when their loan lookup tool says it “appears” that Fannie Mae “owns a loan” at your address. It does APPEAR that such is the case, but in fact that is not the case at all!     Some words of advice from a former law enforcement officer.

    When you get to jail, do not look anyone in the eye; do not act like a tough lawyer; the first guy who says hello to you will adopt you as his wife; money means nothing in jail except to avoid your next beating; take condoms – not for you, but for your cellmate.

    Enjoy your life in prison!
