On October 7, 2010, PNC Bank reportedly announced that it was suspending foreclosures for 30 days. An examination of the Affidavits and Assignments filed by PNC shows why it may have decided on this action. For documents needed to foreclose, PNC relied heavily for the last two years on Nationwide Title Clearing in Palm Harbor, Florida and Select Portfolio Servicing in Salt Lake City, Utah. Nationwide Title Clearing (“NTC”) was one of the first companies to come under fire for using robo-signers.

Bryan Bly, the most famous robo-signer at NTC, signed thousands of Assignments and Affidavits as “Vice-President, PNC Bank, as successor by merger National City Bank, successor by merger Harbor Federal Savings Bank.” On many documents, an Ohio address appears underneath Bly’s signature. Bly, however, was never a Vice President of PNC. This was just one of the many titles Bly used so that NTC could produce documents needed for foreclosures.

On other documents, during the same time period, Bly claimed to be Assistant Vice President of Select Portfolio Services; Vice President of Citi Residential Lending; Vice President of Suntrust Mortgage; and Assistant Vice President of National City Bank. In interviews, Bly admitted that he did not have time to read the documents he signed. Despite claiming to be an officer of Select Portfolio Services, Bly is not listed as an officer on the records of the Florida Secretary of State.

Despite listing addresses in Ohio and Utah, Bly’s signature is always notarized in Pinellas County, Florida, the actual location of NTC. Bly’s many titles are often notarized by the same notary who claims to have personal knowledge that Bly is, in fact, an officer of these many companies. PNC also regularly used Select Portfolio Services (“SPS”) in Salt Lake City, Utah as a servicer.

Bill Koch of SPS has the same problems as Bly – using too many titles and signing thousands of documents each week. Bly also signs for Green Tree Servicing, LLC, but the Green Tree address is listed as c/o NTC in Palm Harbor, Florida.

In recent months, PNC has also regularly used Richmond Monroe Group in Missouri as its servicer. The frequent signer for Richmond Monroe Group is Renee Durham who is identified as “officer.” It is very unlikely that PNC can review all of the foreclosures with questionable documents in 30 days. In Florida, PNC has most often used The Law Offices of Marshall Watson, a law firm under investigation by the Florida Attorney General, to foreclose.

Everyone wants to do the right thing with the foreclosures… what about all of us who are now homeless…because we entered into a contract to buy a house….and now our sale has been haulted… because of bad paperwork/filings…. now we are homeless, costing us a lot of money, while the bank refusing to return our $$$ to us for the appraisal, Inspection and HOA transfer fee… someone has got to do something ….. This is such a mess… our new house is sitting vacant… we are homeless, waiting to move into our new home and can’t!

Re: The letter from the mortgage bankers to our Gov… This letter is just another attempt to scam the American Public and conn senetors into creating another late nite passing of a bill to give a blanket protection for all the fraud committed by the well to do connected fat cats. In the begining: If most of the judges had only given the homeowners a fighting chance to go to trial, the truth about Foreclosuregate (the decades Greatest American Scam) would have been stopped in the very early days. The truth would have come out a long time ago. The Florida bar should be ashamed of themselves for not stepping in and sreversing the potential violations by the duly appointed. They need to do a mush better job of policing the forclosure mills who hired the companies that forged all the documents and they should also condem all the judges who put families on the street via the summary judgements. This fiasco in the foreclosuregate scandal has only gotten deeper and deeper because many Judges all across the country were acting like hardly ever give the homeowner a fair chance to prove their case in court, many judges took it very personal and just said pay your dam bills and get the hell out of my court room. I am however very proud of some judges who always did the right thing when it come to protecting families, but many hate the poor who are struggling with debt and they hate them tying up their courtrooms. Just look at some of the recorded foreclosure cases in Florida and you will see for yourself how they are treating the attorneys and the homeowners. Summary judgments, disrespect for defence attornies and clients and utter rudness is common in some court rooms. Rocket dockets and retired judges are the rule of the day in Florida and that may prove to be against the law. Some judges have treated lawyers defending homeowners like idiots and banned most the truth from the court room with their summary judgments. Who will eventually pay for the judges mistakes when all the homes sold to new buyers are given back due to fraud? Thats right not the judges who took homes, its the tax payers. Talk to any defence attorney and you will see how the some judges took so many homes and then put families on the street. Many attorneys say serious violations of ethics and rules of law may have been broken but most wont say it publicly because they fear they might lose their licence’s. I always believed as a child that all judges were here to protect the American family from fraud and abuse by the big guys but sadly I came to find out that I was very wrong. The real Hero’s are the Good judges protecting Homeowners and families, the hard working defence attornies like April Charney, Matt Weidner, Mike Wayslic and many others like Ice legal. But most of all its sites like these that are getting the truth out. Keep up the good work people you will be rewarded.

  6. We are in agreement that there is a criminal and civil RICO cause of action as it relates to the mortgage industry since the Glass Steagall Act was repealed. The Defendants are staggering, and that is because these people purposefully made this so complex they believe no one could open all the doors to this scheme. They are WRONG!

  8. Anonymous, I have read many of your post, and must say that you are very intelligent as it relates to this Ponzi scheme. I have been silent on this site until yesterday and have made a few posts since then. My father-in-law is a retired FBI agent; he was attached to the organized strike force for years. I have shown him some of the evidence I have as it relates to the criminal activity surrounding this matter. Yesterday he suggested I forward what I have to FBI Headquarters and to the New York Times or some other large News outlet to rip this wide open. This matter is so complex that it would take a team of investigators months to unravel their scheme, however this is not to say it cannot be done. People keep asking, where does the money come from, it comes from the banks infra. These banks (which are not allowed to lend money for residential loans, are not registered or licensed to do so in any state or this country) fund the money for our loans. They have circumvented the laws by entering into agreements with residential lenders, (pretender Lenders) which allow them to draw money from the warehouse pools. Now, this is just Countrywide info I have included, but all the pretender lenders do the same thing.

    You are absolutely correct – cannot fall asleep at the wheel. I have seen too much and know – there is always another trick up the sleeve.

    Frankly, we need an investigation of the OCC. The OCC will not investigate anything – and Why Not??

    The banks are doing their own audits of invalid foreclosure filings – Oh – that is real comforting!

    However, now is the time to take advantage of this situation – both in court and by complaint to every government agency and DOJ. File complaint with OCC – but copy it to another agency and/or DOJ. Now is the time to really join together.

    Senator Dodd having a meeting next month. Would love to get an organization together and ask permission to speak before them.

  12. Do not be lulled to sleep by the sudden halt in foreclosure by the major perpetrators in this massive Ponzi scheme. This is a sham and this lull is for them not us. This is a risk management matter for them and now they are Brain Storming to find yet another way to circumvent their criminal behavior.
    Let me make a correlation for the people on this site for some further analyst. Mortgages have been securitized since 1974, and until 2000 there were really no blurbs in the securitization of loans. Let’s not forget that many types of loans are securitized, and the only mess is the Mortgage industry as we know as of yet.
    Therefore, this begs the question, why, what happened?
    MERS was created in 1998, coincidently, so began the total dismantling of the Glass Steagall Act of 1934 (GS); coincidence or conspiracy. The GS was enacted to break apart the financial institutions to ensure that we never suffered another systemic financial failure like we did during the Great Depression as a result of their Greed and Destructive behavior. Who lobbied for the Gramm, Leach, Bliley Act of 1999, who lobbied to have the GS repealed, the very people responsible for the Murder of a Nation, Wall Street Big wigs and the largest Banks on the Planet!
    I use the word murder, because that is exactly what they are Murders. In the face of foreclosure many citizens have committed suicide, and in some cases killed their children then themselves.
    They are Murders of a Nation and the Citizens within it. If I walked into a bank with a gun, robbed the bank and shot the teller, and was caught, I would get life in prison without parole, a just punishment for a heinous act. Their weapons are the pen, money, power and corruption and the citizens in this country are the wreckage left in their destructive wake. Monitory incentives breed corruption, and our political machine is corrupt to the core. These criminals are the most destructive element to tear this country apart since the Civil War.
    Who here is aware of Operation Stolen Dreams, it is an FBI probe which has (as of July 17 2010) yielded 1285 indictments for bank fraud of which 485 people were placed in handcuffs and taken away.
    The point I want to make here is that, I was on the phone for an hour the other night with the Office of the Comptroller. At one point in the conversation, I asked the person I was talking to if she was aware of the status Operation Stolen Dreams, she had absolutely no idea what I was talking about. Can you image, I had to explain to the government official what it was and why. I told her that I was astonished that the OCC had no idea of this operation whereas they are the government entity which oversees the National Banks in this Country. Outrageous! If we want the government agencies to act, we must make them aware, because clearly they are not.
    Every person who has a valid claim must file a complaint with the OCC for National Banks and the Office of the Thrift for all other banks. You must flood them with complaints. I believe the OCC might relish in the fact that what they advised against in 2003 has come full circle. See OCC AL 2003-2 Predatory Lending. You can access this document on the OCC web site. It is a must read for all concerned and a weapon for those who might file suit.
