Make it Real, Mr. President

The Quote of the day in the New York Times reflects the main sentiment: to most people the economic recovery doesn’t look real. REALITY is what I’ve been seeking from government, the marketplace and the judicial system, but we just can’t seem to get it.

  • They want a housing recovery but there is no plan in place to increase median income, which is the only reliable indicator or predictor of housing prices. Increase jobs, increase income, and you increase economic activity, tax revenue and the economy thrives.
  • They measure and proclaim rising reported profits under a wink and nod accounting system that began in the 1960’s and which led to items being taken off the balance sheet or income statement if they looked bad on a company’s financial statements — but they don’t talk about median income which has shrunk for more than three decades, “offset” they say by rising debt. Exactly how is a lack of income offset by increasing debt. Could someone explain that to me?
  • They want people to have confidence in the financial system that has tricked, scammed and stuck American and foreign citizens with a bill whose proceeds went into the pockets of the management of companies whose sole purpose was to get people into more debt. For every dollar spent by a consumer, business or governmental entity, $10 in fake and real money went into the pockets of “financial innovators.”
  • They want people to have more confidence in the marketplace and start buying things they don’t need, when they don’t have the income, the savings or the credit to buy the things they DO need.
  • They see the problem with mortgages and foreclosures but their plan is to get them modified without actually changing the terms.
  • They send money into the financial system to get the players to modify the mortgages, but the players they are talking to don’t have the mortgages, don’t have the authority, and make a lot more money by (a) pretending to modify mortgages and then taking federal money and (b) foreclosing on property so they can apply unconscionable fees to the detriment of both the borrower and the lender (investor) who advanced the funds for the deal.
  • They want more jobs created but they don’t do anything to stimulate the creation of small businesses which for 2 centuries have been the sole engine of economic growth and median income. Liquidity from the Fed has been reserved for financial institutions to keep trading with each other creating fictitious profits, creating no added value to society or the marketplace — no service, no products, just trades that give the appearance of profit.
  • They want the deficit down which has largely resulted from a decrease in REAL economic activity, so they want to cut expenses which will decrease economic activity even further. Just what do you think those people losing jobs are going to buy? What businesses are they going to start? How will they capitalize their businesses or their life-style with no money? What we are seeing is an instant replay of the 1937 error, which FDR admitted, when he finally gave into the deficit hawks and the Country plunged even deeper into depression.
  • What business has ever prospered by cutting revenues, channels of growth, innovation and employment? NONE. But that’s the plan that is being seriously considered for government by people more interested in their election prospects than they are in the prospects of the country as a whole.
  • What business allows it’s biggest customer to not only skip paying their bills but gives them more money without any hope of getting it back? NONE. But that is what the State and Federal governments are doing when they fail to collect taxes, interest, fees, costs, penalties and damages from enterprises doing business, making money and not even reporting the trade as a profit, much less paying taxes, recording fees etc. That is what they did when they pumped $5 trillion into the financial sector to prop it up so that the world would not see how stupid and greedy our financial geniuses were and how relentless they were at pursuing and creating even fake money at the expense of the welfare of the entire world?

The problem is not that we are broke. The problem is that Wall Street has our money and won’t give it back. The problem is that they did it by tricking citizens into fake deals (stealing the purse) and making a culture out of life-styles of debt. The problem is that they took the one asset consumers had left — their house — and inflated the apparent value using sophisticated means far beyond the ability of the understanding of the average person, and then had these hapless people sign onto deals that were “backed” by property that was not worth half of the deal. Both the borrowers and the investors got stuck with the same lie.

So, Mr. President and the rest of your genius dream team of economic advisers, I realize that you are trying to do your best to avoid drama. I realize that you are trying to prop up an unsustainable economic infrastructure in which more money was created ($600 trillion) than we could ever hope to cover in a world where the real amount of government issued currency is less than 1/1oth that amount. And I realize there is no precedent for what has occurred here and the magnitude of the problem. It is brand new in human history. It is a fraud of unimaginable scope. But using old techniques of trying to kick the can down the road is not going to work. It can’t.

The likelihood is that if you let the bubble burst, which most people don’t realize exists, but investors are starting to get nervous about, the real loss is going to fall on the financial players who created this mess and who incidentally are holding the real money; the counter-party trades will neutralize a large part of the apparent money bubble that looks like it is there (but isn’t); and demonstrating that you are dealing with truth and reality will allow people, companies and government to deal with reality instead of maintaining the fantasy of Wall Street infallibility. THAT is when people will have confidence — when they know they are being told the truth.

If you have guts in addition to hope, if you have grit in addition to steadiness, if you have imagination in addition to your formidable intelligence and knowledge, you know that eventually REALITY will govern whether we like it or not. The quicker we get there the fewer people will suffer. The faster we take the brave steps amidst loud crises of “traitor!” the faster will have REAL RECOVERY. There is nothing in the world that is ever going to bring home prices back to where they were quoted when these deals were done. We ALL know that. The economy cannot really recover until median income and housing needs are fixed.

The goal here is not to assess blame but to QUICKLY spread the risk of loss in a fair and equitable way — just like derivatives were supposedly doing but in the hands of liars and cheats did quite the opposite. Right now the consumer is taking the brunt of this in debt, taxes, expenses that can’t be met and loss of self-esteem. American ingenuity has taken a direct hit and it is up to you, Mr. President to revive it in a wholesale shift, not in your favorite incremental steps.

    Federal Court: Borrower is INTENDED 3rd Party Beneficiary of HAMP – Homeowner Sues for Breach

    This is getting interesting. A judge in U.S. District Court, Southern District of California, has issued an order that may just answer a few prayers of many homeowners. Here’s what happened…

    A San Diego homeowner, by the name of Ademar Marques, was applying for a loan modification, and, although it might be hard for many readers to believe, his servicer, Wells Fargo, dba, America’s Servicing Company, wasn’t being very nice about it, or even cooperating at all. It seems that Wells Fargo wanted to just skip all of those messy and time-consuming formalities required when considering someone for a loan modification, and just jump straight into foreclosure.

    Mr. Marques filed a lawsuit against Wells Fargo’s America’s Servicing Company because he read about the Home Affordable Modification Program (“HAMP”) and the program’s guidelines said that his servicer was “REQUIRED” to screen him for a hardship, and consider him for a loan modification. He also alleged that he qualified for the loan modification program based on all of the published guidelines, and that his servicer, a participating servicer in HAMP never said that his loan could not be modified, they just refused to modify it, and instituted foreclosure proceedings.

    Well, I never! The gall of some servicers. Have you ever heard of such a thing? Actually, I have. But not more than 30-40 times a day for the last two years.

    “On or about April 13, 2009 Defendant entered into the Commitment to Purchase Financial Instrument and Servicer Participation Agreement for the Home Affordable Modification Program under the Emergency Economic Stabilization Act of 2008 with Federal National Mortgage Association (“Fannie Mae”) and agreed to perform certain loan modification and foreclosure prevention services for eligible loans.”

    “Plaintiff filed a complaint in San Diego County Superior Court alleging breach of the Agreement on the theory that he is a THIRD-PARTY BENEFICIARY under California Civil Code Section 1559, that his loan was eligible for modification, Defendant refused to offer to modify it under the Agreement, but instead commenced foreclosure proceedings.”

    I know nothing. I don’t even think I know anything, and I don’t give legal advice. I don’t know legal things.

    Nice speech. If they were concerned about these laws, they would be implementing the changes so the laws could not go into effect.
    I’m reminded of the passengers that were stuck on those airplanes for ridiculous hours because the pilot didn’t want to turn back.
    Right at the precipice of change, when they were going to pass laws, the airlines made their own changes.

    Do you see that happening here? Does the news media everyone is waiting on, who’s higher bosses eat dinner at the homes of the banksters doing this mess even care? Are they reporting this? I’m sure the anchor person wants to keep their job. They will report what they are told to report.

    Obama can’t do a thing about economic policy. Not a thing. Not a thing. So stop waiting. Congress has their hands tied. Their souls were sold a long time ago. Take the old out and put the new in, and they still have to barter, beg, and lie their way into a position to make a difference, or to get on a committee that will make a difference. They can’t come down and mix and mingle with us. They stopped working for ‘the people’ a long time ago. They are their own government.
    Our checks and balances were destroyed a long time ago.
    The scales of justice are being held by a see no evil, hear no evil, speak no evil set of ‘things’ calling themselves human or even man.
    If we sit back and wait, and this has been in the works since 2007 as I watched it unfold on a blog called doctorhousingbubble.com then you will just be ‘a waiting’.
    There was plenty of time to change things, and to make a difference. Right now, we are watching the titanic sink, and thinking the government can make a difference, is…….well you’re entitled to ‘think’.
    Of all the presidents, most were related to each other, of the 40 some odd presidents we’ve had, maybe 4 were not related. Obama is related to previous presidents in some way, shape, form, or fashion, and this is an ‘all in the family’ situation. He’s not going to change a thing. He can’t. He’s the CEO of a corporation called the United States of America, and it’s got hidden departments and private divisions that are run on a need to know basis and he has no need to know. The corporation needs someone to speak for it, and that’s all. He’s not making any decisions. When they are passed to him, he’ll sign with multiple ink pens and give away the pens.
    Wait if you must, the plan will keep moving.

    We have a better chance of the whole house of cards falling and starting over as there are those of us in humanity that will help and will know what to do for us to rebuild.
    This entire system is geared toward the fearful. Those that are stuck in analysis paralysis, waiting on the Messiah to come save you. Well if you look in the mirror, you are it. You are made in the image of the Creator, the Creator is within, and as such you have the very powers you are waiting on.
    As soon as we wake up and stop waiting on our salvation from the top 10%, the better off the 90% will be.
    I tell you a person hungry, and homeless will not notice if this country turns into a third world country. They are already living in it.
    I would lose everything to walk a mile in the shoes of the less fortunate and that’s why the banksters have that home now. Think they’ll let it collapse? It’s a drug. We’ve all been caught in one big monopoly game. Let them figure out who won, and then game over! So what’s next? Selling it back and forth to each other? Without any players, there is no game.
    Frankielee states it well. Stop negotiating with liars and thieves. Either it’s your home or it’s not. Before this mess, we knew it was our homes and under what conditions it was our homes.
    Someone changed the rules of our contracts and now there are ‘no’ rules and people are trying to figure out what the conditions are? If they can play with the conditions, they will always change and you will forever be their slave, and NEVER own the home and look back and wonder why you didn’t listen when you had an out.
    I gave sweat equity to my home. Found out it’s not mine.
    They can gauge the fear factor of the populace based upon what people are doing in this crisis.

    There is no FBI for ‘the people’, there is no President for ‘the people’, there is no Congress for ‘the people’. There is no justice for ‘the people’, there is no remedy for ‘the people’. Comptroller of Currency, Police, Judge, Supreme Court, nothing.
    We ‘are’ on our own, and still looking for someone to help us.

    Wake up. We are on our own.
    If I was an auto shop, and had nominal business, and all of a sudden, everyone was bringing their cars to me saying it was broken and it happened after the purchased gas at a particular gas station, (it doesn’t take a rocket scientist to realize, there was something wrong with the gas, because all these makes, models, and body type and engines can’t all fail at the same time for different reasons when the common factor is the owners bought gas at a particular gas station.)

    You mean to tell me, that our judicial system doesn’t even recognize a problem, and are looking at the car owners and telling us we didn’t take care of our cars. All of us at the same time, and because of that, and each car has different mileage, purchased at different times, from different manufacturers, that it’s our fault that the car is having trouble, and as a result we should lose our car.

    Hmmph. That’s what I’m saying. The fraud runs deep. We point anywhere we want and there it is.

    If there was a smidgent of honor in the entire system, I’d be at my home paying my mortgage to the company I negotiated with and created the obligation with and it would still be in favorable terms that are achievable.

    Others would be in their homes paying their obligations as promised on the terms that were favorable, and the economy will be buzzing along.
    Many will deal with the consequence of their intentional blindness.
    The sooner you drop out of the game and watch it fall, the better off you’ll be.
    I’m not hoarding food, or supplies or anything. I’m letting all the chips fall where they may. I told my daughter, we’ll be like Survivor Man, eating leaves from trees or blades of grass or something before I allow fear-mongering to make me start hoarding and preparing for whatever they are going to do next.
    I can almost see their playbook.
    We rode around today, and there were so many places with empty office spaces or empty buildings. All these For Lease signs.
    Yet, there is a bank and a pharmacy a gas station, a WalMart, on what feels like every corner (exaggeration). Bottom line, the world they help create, they have to live in it, too. I’m beginning to see why there’s a pharmacy everywhere, can’t quite figure out the bank thing, but in a one block radius there’s three, two are next door to each other.
    Somethings coming, and the plan is already in place.
    That’s where ignorance, and waiting on someone else to save you will lead to a surprising truth for many.
    The market you are afraid will fail, already has. Only a few are trading and keeping it active. But you don’t know that either.
    When the time comes, they will stop trading back and forth and you will see.
    Obama can’t do a thing. Not a thing.

  4. What “recovery”?

    If you belive that, then there was no massive fraud and none is still going on.

    For two areas I looked into last week, the median home prices are still declining with the latest statistics showing 16 and 38% respectively…recovery? Yeah, right!

  6. Right on hkcon. The question is more like…are the democrats or the republicans the problem…and the answer is…YES!

    There is no modification acceptable with lying bankers.

    There is no negotiation with lying bankers.

    There is no resolution with lying bankers.

    Why? For the simple fact that they are in their penthouse towers due to lies and corruption and fraud. The United States refuses to negotiate with terrorists, because it gives them legitimacy. Same deal here. To play along, even for a moment, that these thieves are worthy of that kind of respect or power is to concede that the terror they are committing is acceptable at some level.

    Remember Neil’s truism from above….Wall street has our money and won’t give it back. Why should we discuss terms with thieves?

    And since the fraudster bankers have shown no clemency or compassion whatsoever, I say no quarter should be given. This is war. They must be brought down completely. Only then can this system by purged and rebuilt. Trust that without change, the way forward is just as frought with danger as has been the past, as NOTHING has changed. They’re still coniving, cheating bastards who will stop at nothing to get it all.

  7. This blog is a-political, meaning it has no politics. If, and granted that is a big if, I am reading N.Garfield’s post correctly, then he is not blaming Obama for the situation, but instead saying that the reality is A and to fix it you must do B. Period. No blame, just the reality supported by the facts. Those who wish to blame Dems or Repubs, first, miss the bigger picture, which is that it matters not who you support or whose BS you believe, the fact and reality is, HERE WE ARE. Secondly, and just as importantly, if you think that either Dems or Repubs are the answer (read GOVERNMENT), then again you put your faith in a system that has been taken over by the very people that allowed and profited from the situation. Third, you waste valuable energy arguing the point of who is to blame and that is counterproductive.

  10. The only thing I see is that we need to organize and take actions together in our different counties and states.What about a lawsuit filed in every county on the same day would/could make a statement the press would pick up on.

  11. Im sick and tired of those of you bashing Obama. What do you want more of Bush and his policies that got us here? Look at healthcare and we NEEDED that and look what we had to give up to get something. Stop bashing and do something–don’t you realize you are going to get nothing that requires any help from the republicans. Don’t you think OBAMA and his team realizes the problems–What are you going to do–have 62 million mortgages go down the tube and have chaos? Not going to happen. We got some reform, and we got some lender liabilty. If the Republicans were in they would be passing laws preventing us from even suing. Get a life and understand the realities of passing laws in this country and the reality of what would happen if Wallstreet really got socked–the entire system would collapse and we can’t have that–we would become a third world country.

    O I can’t wait to hear all you Tea Parties and Patriots and Oath Keepers weigh in with “to the streets” rhetoric. Get real. We are better off than we would have been–there are new laws that are better than we had no laws at all under Bush/Cheney and the Republicans. We are moving in the right direction. As mom used to say “a half a loaf is better than no loaf at all”

My next step was trying to get a summary judgement , In discovery they produced a lost note affidavit signed by the “VP” which she was not I have a payment coupon from her welcoming me as a customer dated 8 days after the date on the lost note that says she is a customer service manager. The successor trustee and the servicer produced 2 allonges that are undated and even one is not even signed. Of course you already shoulds know they were not attached to the note because I have it. I also have a sworn affidavit from the servicer who was the owner at one time and the depositer into the asset backed securities where she states that they did sell the note to JPM although a written assignment NEVER occurred. HMMMM

  14. Yes the original lender that is now defunct mailed me the paid in full stamped note. The last page of the note is a signature stamp by the real VP of the company. ( I checked) endorsed pay to the order of …..Blank.

    How did you get the note? Buy it in the secondary market? Did they mail you a blank endorsed paid in full bearer note? What is your “time horizon” on whatever your “next step” is? I am not an attorney but I see this as opening up a whole new can of worms if they have prevailed despite this physical evidence … The next step could benefit not only you but thousands with the same lender in your state. Good Luck.

    I didn’t say that, the person in the article said that. That was what he was predicting.

    If the economy continues as it is, I could very well see his predictions taking place.

    You should have already been prepared! We have a lot of tornadoes here in Arkansas. I have a lot of Brothers and Sisters, Children, Aunts, Uncles and so on. We have a plan in place in case one of us are blown away. We also have a plan in place if there is anything else that should come up.

    Until that time comes, get an audit and fight like heck…ok hell…..

  22. Neil, your blame is misplaced! Does it make sense that our President is responsible for the many years of legislation that was put in place long before he took office that is still kicking in today? How is it that one man, President Obama, is responsible for all problems and none of the men who were in charge before and still presently in government are held accountable? Why are the men always excused who are responsible for all the problems by calling their criminal acts mistakes, greed, blunders or the like in other words not holding them criminally accountable?

    History tells us that Europe emptied their jails and sent the criminals to the States, Australia and other places, so this country started with criminal minds and their descendants have followed suit. Admit it, crime is a way of life for these men always was and always will be. It is well documented. The criminal activity of the financial industry is not a surprise; it is just a surprise that they have been able to do it on such a large scale, affecting so many people, countries and so many industries. They are good at what they do, good criminals.

    So the question is how do honest people create a sustainable society when you have criminal minds in positions of power that are always looking for loopholes or ways around the rules and laws? As one of the big banks CEO’s said in a TV special, “As fast as the congress passes laws we are looking to find ways around the laws, including changing our business structure so the laws doesn’t apply to us, so it doesn’t matter what they do.” The criminals also “lobby” (pay) the congress to repeal or not pass laws and /or pass watered down laws that favor them. Or they just ignore the law and pay the justice system to side with them, all criminal mind activity.

    Funny, Obama isn’t in any of the above; he is sitting in the White House looking for ways to make an honest sustainable society and the criminal minds outside and inside of the government won’t let it happen. The sad part is that it looks like there are more criminal minds and criminal mind sympathizers who speak with forked tongue than there are honest good people. That is what is being revealed now. Silence means agreement. If you’re not part of the solution, you are part of the problem.

    Obama has never been the problem, the problem lies with the people who are still in Congress, the people who still work in government from other administrations, the corporations, organizations, haters, criminal minds, gangsters, weak people who go along with the criminal minds, racists (people against anyone not white), the power hungry and let’s not leave out the people who want to maintain the status quo who don’t want to lose the exceptional way of life that has been given to them by the criminals as long as they go along with the program.

    President Obama is not a dictator. The Congress/Senate has to pass the bills not Obama. He has announced, met with and many other strategies to get things passed and you blame him when bills are stalled or watered down by congress? Wrong! Plus, lobbyists pay more than the constituents; check your legislator’s financial gifts, campaign donations, etc. Funny, I don’t hear you complaining about them???

    Ok, so what are the honest people to do? Are the honest people out numbered? Where are the honest people, because they sure aren’t the major media or bloggers? Obama thought that the honest people were behind him when he got voted in, then before he could turn around, some of the same voters turned on him before he could find his way around the White House. These voters are childishly acting as if change happens with a snap of a finger even under good conditions. These people know the obstruction President Obama is dealing with but refuse to give him time or support to bring change, they should be ashamed, but they don’t seem to have any shame. Or maybe they don’t want real change?

    As usual in this society, the victims are always blamed for causing the crimes. President Obama is being used as the fall guy by the criminals who know that there are haters who will go along with the idea. Another sad thing is that even if President Obama were impeached today, this country would still be on a fast ride to hell. He has just slowed the ride during his tenure. As long as the criminal minds and their sympathizers are allowed to get away with the crimes they are committing, this country and the world will be in their last days and the earth and the majority of the people will suffer irreparable harm.

    What is next family? Who has a good sustainable plan? You can’t shut down the banks, military, corporations, oil, schools, etc unless you have an alternative to take its place when the shutdown occurs, so where are the alternatives? Who has the answers to that? It’s easy to complain, and to call for change, but who has the solutions? Yes, it is on the good people to bring the solutions that will cause the change, but for good, not another version of the same.

    Thanks for the Strong Words….believe me it needs to be said.

    I believe what you are describing is called Thief by Deception and there is a law can be used to put them in jail.

    The problem is we just do not have enough support to carry this out. Most folks do not have the funds to hire some one to help fight to keep their homes much less pay the utilities and bring in some food to eat.

    I was doing some research about a month ago and came across an article that one person said that in 2012 most Americans will be spending 80% of their time working the ground raising crops to put food on their table. This person has been pretty close on his predictions.

    Unless we “all” do something now to secure our future all of our time will be used to feed ourselves as there will be no fighting time….

  25. Although Neil’s post was aimed at the president, I think it has become all too clear that change is not going to come from Washington. We’ve been waiting for that train to arrive for two years, and there’s exactly zero sign of that changing.

    It does come down to we the people affecting change. Only when enough people outside of Wall street and Washington start demanding change do we have a hope. It needs to become too politically dangerous for politicians on both sides of the aisle to risk further abusing their constituents. This is war.

The heck with making it a petition – make it a legal document Neil – one that we millions of Americans can sign as a form of lawsuit – word it so it is clear that it is a lawsuit on behalf of us all – “you draft it, and they will come . . .” we’ll sign it – there isn’t an easy link to connect all of us in a massive class action lawsuit; so maybe word your letter somehow so that it is a class actionable pleading – to be filed in every state and every county – I’m sure each one of us is willing to monitor/file documents in each county superior or common pleas court on behalf of each American – imagine – one document drafted to be filed with every court in the Union – put a doc together Neil and we’ll sign it, help with filing, etc., we’ll even financially support the process – just do it and let us know! I’ll handle filing in all counties of PA – get someone from each state to act as a sort of turnstyle for document processing and handling – I’ve got 30 years as a litigation paralegal and I’m on board!!

  30. I need an Attorney who get’s it in South Carolina. My case is a little different than any case ever in that I have the Original note signed in blank, duly negotiated to me. I’ve been through discovery, summary judgement and a deposition.     think you’d cut to the chase by the end of the weekend, if given that role.

    When it finally becomes clear that the fed’s printing presses can’t possibly keep up with
    Wall street’s lightening fast dissipation of electronic funds, the game’s over. When the
    TBTF bank’s balance sheet hocus-pocus is scrutinized in the light of day, not some
    crowded with suits, secret boardroom in Sacs penthouse, or in Geithner’s personal panic
    room where he speed dials Jamie and Lloyd looking for the correct treasury response, the
    game’s over.

    I say bring it down! What do I care? I mean really! I’ve lost: employment, insurances,
    savings, equity, and now comes housing, the only thing left that made the first ones less
    painful, having a place to rest, if you can call it that, and get a good night’s sleep (rarely).

    I welcome the day with open arms when Wall streeters look into the abyss, one that was

    for that one last fraudulent, self-indulgent, reach around scheme, that last deal that is just
    too lucrative, too rich to pass on. The big one. Bring it on. I look forward to having many
    of you on my work crew. Just don’t expect me to be quite as understanding at your lack of
    real world skills as Geithner’s been.
