It is classic obfuscation and musical chairs Note that Deutsche Bank is identified “as trustee” but the usual language of “under the terms of that certain trust dated….etc” are absent. This is because there usually is NO TRUST AGREEMENT designated as such and NO TRUST. In fact, as stated here it is merely an agreement between the co-issuers and Deutsche Bank, which it means that far from being a trust it is more like the operating agreement of an LLC)

I have one loan# and they created the other loan # on my mortgage too. There is a big fraud behind the two loan# and on one which is on your Note and DOT, every one has been foreclosed on that without your knowledge, only MERS and the Title company knows that. Now they are foreclosing the people on a loan which they created and which does mot have any concern on your Not and Mortgage.
In my case I have verification from these thieves and SEC too. I have certified record from the SEC. The figures I stated are 100% correct.
??? This is so insane. So you mean every one of those entries is your loan? They are just claiming it’s a portion of it entered on different dates? And they just make those figures up? Each one is a different loan number. How do you know those loan numbers refer to your loan? This stuff is nuts.

This amount is on the Note, which was sold in more than 48 Trusts/pools (sliced and Diced), six times each in each trust and it was sold for the amounts as shown in the trusts. The amount on the note does not show and the amount it was sold for is shown against each loan#

You say your loan was $491,250 . . . I don’t see that amount in any of the trusts you list. Which items in the trust list reference your loan?
When fighting DB (or anyone else who, as Trustee or otherwise, acquires a mortgage and note after it is in default) . keep in mind your state’s laws regarding CHAMPERTY. Ohio, in particular, will dismiss actions where the plaintiff has engaged in champertous conduct. (Champerty is the crime of investing in a lawsuit where the investor had no prior interest in the transaction .) What we are seeing is investors , losing money on the pooled mortgages, trying to recoup losses by purchasing defaulted mortgages that are already in litigation for pennies on the dollar, and then hoping to profit by grabbing the mortgaged property and selling it (not to mention obtaining deficiency judgments). Thus, it is not “mortgages and notes” that are being securitized, it is “lawsuits”. (That also explains why people cannot refinance.) I have already used this argument to win three foreclosure cases, where the cases were dismissed with prejudice. Not every state stil recognizes champerty, but give it a try.
1. Raj – I am helping on a matter where Douche Bank is foreclosing in it’s own name and where the sham assignment goes from the orginal lender to DB. Consequently, without a trust number I can’t find the where the loan has been pulled. Like you, I believe they are hiding the true trust number because it was sold multiple times.

Trustees job is done – as these SPVs are dissolved as mortgage loans are now consolidated on banks balance sheets Trustees can not even trace the loans -only the servicer can – maybe.
Here is something that I found which might help getting your head around the trustee thing:
Asset securitization segregates the assets to be securitized from the business of the securitization’s sponsor (the “Originator”) by transferring them to a special purpose entity (“SPE”), often a trust. The trustee of the trust usually subcontracts the administration and servicing of the securitized assets back to a subsidiary of the originator of the asset pool or a third-party provider. However, the trustee remains responsible for administering the SPE or the trust that holds the securitized assets.
The trustee’s primary duty is to protect the interests of the investors who purchase the securities issued pursuant to the securitization and administer the duties of the SPE under the requisite agreements. The nature of the trustee’s duties are specifically set forth in the trust agreement, and frequently require more intensive involvement by the trustee if covenants made by the Originator as part of the transaction are breached.
Ensuring title and perfection of security interests
The trustee will see to establishing the trust that will serve as the SPE for the asset securitization. The trustee also must confirm that the trust has received clear title to the assets, free of any claims or charges, actual or implied. When assets are transferred to the SPE at closing, these assets are pledged to the holders of securities issued by the SPE. Since the assets will serve as collateral for the repayment of the securities, the trustee must also confirm that security interests in the assets are perfected in order that the assets will not be vulnerable to the claims of other creditors of the company – that is, they will be “bankruptcy remote.” The trustee usually accomplishes this by requiring legal opinions that the security interest has been perfected.
Working with the servicer and administering the trust
The servicer, under a servicing agreement between the trust and the servicer, will typically provide payment collection services, remit payments from collections to the trustee, and provide administrative support to the trustee by preparing informational reports. For example, the servicer will generally provide monthly or periodic reports and details on amounts collected and amounts charged off related to the underlying assets. The servicer also will administer the disposition of trust assets.
The trustee will oversee disbursements to the investors that are due under the terms of the securities issued. The trustee regularly reviews the reports and information provided by the servicer to ascertain whether the assets securitized will produce a cash flow necessary to meet the trust’s obligations to the investors. The trustee also will be responsible for managing and investing any funds that come into its hands as trustee. The trustee will see that tax forms required pursuant to administration of the trust are filed.
Ensuring compliance by all parties
One of the most important duties of the trustee is to monitor the compliance by the other parties in the transaction, especially the Originator of the securitized assets, with their respective obligations under the transaction’s documents. Although it generally plays a passive role at this stage of the transaction, in the event that the trustee is notified of a breach of these obligations, its duties take on a much more “active” character, as it notifies security-holders of the breach and awaits their instructions regarding its next actions on their behalf. The trustee is normally entitled to be protected by the security-holders against costs and expenses of complying with their instructions, and may ask for an appropriate amount of funds prior to proceeding with the requested action.
If problems begin to develop indicating a potential for default, the trustee will notify investors and cooperate with investigations and negotiations (if any) surrounding the matter. The trustee may meet with the servicer concerning actions necessary to avoid default. If the servicer fails to perform its duties in accordance with the agreement, the trustee can replace the servicer. Examples of events that might constitute default include failing to handle or advance funds as required under the servicing agreement or failure to maintain an acceptable financial condition. If the servicer is replaced, the trustee often serves as a temporary servicer until a replacement servicer can be identified and employed.
Experienced trustees make a difference
Asset securitizations are complex transactions involving multiple parties with multiple interests as well as accountants and legal professionals. An experienced trustee at the center of the transaction performing administrative services for the trust or SPE can help steer the parties smoothly through the process. Experienced trustees are typically better able to ensure that asset securitization will achieve the goals of the originator of the asset pool, whether the company whose assets are being securitized is experienced or is using asset securitization for the first time.

I received a printed copy from the Deutsche Bank, in reply to a complaint I filed against Deutsche Bank to Federal Reserve Bank New York. Title of the Page is “ROLE OF THE TRUSTEE IN THE US MORTGAGE MARKET”
Under the TRUSTEE; It says ” Performs a variety of functions, among them acting as TRUSTEE for the Securitization Trust and sometimes CUSTODIAN FOR THE MORTGAGE DOCUMENTS. A corporate trustee for the mortgage backed securities (MBS) only serves an administrative role, but has no ownership stake nor beneficial interest in the underlying loans of the securitization.
ROLE OF TRUSTEE IN A FORECLOSURE
Deutsche Bank in its capacity as trustee holds certain mortgage loans for MBS transactions. The BENEFICIAL OWNERS of these loans are INVESTORS in MBS, typically large institutions such as pension funds, mutual funds and insurance companies. Although the trustee of MBS is legal owner of record of mortgage loans. THE TRUSTEE DOES NOT ITSELF HAVE AN ECONOMIC INTEREST IN THE LOANS. Moreover the trustee is only NOMINALLY involved in the foreclosure process.

I’m just not exactly sure how to use it. Fannie Mae, who I’m tangling with, sets up its trusts in the same way, with itself as Issuer, Trustee, etc.–playing all the roles, even Holder in some cases.
I guess my question is, what is problematic about the trustee being in a partnership with the certificate holders? I’m not saying it isn’t a problem, I’m just asking why? Is it because it creates a conflict of interest?

Look, if your loan was sold so many times over and over and over, where a quarter million dollar note brought in over $90 million, then that is fraud as far as I can tell.
Why don’t you take your proof into the FBI office nearest you? At the same time, submit your research to Gretchen Morgenson of the New York Times, who has been writing about this stuff.

If I am following you correctly the info you posted shows that the series of loans as noted were included in numerous trusts as collateral for the money received?
Why are the loans shown as being part of the AR4 and AR5 trusts on the lines below the AR 35 trust etc? I’m just trying to get a feel for how this info was compiled and how to see the sales happening continuously.

The FDIC seems to think if the Trusts take title and possession it voids the REMIC status. The cozy relationship with the vulture investors and the FDIC and their smugness is impressive.
Their efforts to fabricate a BFPV bona fide purchaser for value to defeat the homeowners claims is particularly troubling. It is complicity and aiding and abetting.
They are using tax payer dollars to bailout the criminals and then hiring them to take your house, guaranteeing their profits and resecuritizing the dirty paper and guaranteeing it with taxpayer dollars.
Vote them all out and lets clean house. Hug your local lawyer, because the government is not going to fix this.

They can do any thing, to you and to this country and you can see how they did it. I have all of the record and my cases are still in the court since 2007.
Two of the Judges in Federal court played with me as i was Pro Se and I filed the Judicial Complaint against them and went to the appeal court.

It is a long journey, started with these thieves in 2007.I searched on SEC. I have record of all of the TRUSTS these thieves have used. I pulled this record with my loan #. I have a membership with the SEC and pay them. Initially it was free. I printed all of the 48 sales record and it contains 525 pages each.When I go to the court, with a truck load of this record. Since 2007 I am fighting with these SOB, both in State and Federal Courts. The lender on my note and DOT was Indy Mac Bank FSB (I told them that your capacity to maintain judicial action is and was QUESTIONABLE). They filed the motion to substitute “KING OF THIEF” (Deutsche Bank) with the fake, fabricated and illegal assignment in violation of the PSA, Prospectus etc. I challenged every thing and assumed nothing. All of my objection to their each move have been recorded in lands record. I rescinded the loan timely, no response received and rescission was self imposed. They failed to response my QWR and Discovery and “ADMITTED BY NON RESPONSE” this is a big weapon in the court as I have all of the certified return receipts. Due to these the Judge gave me a STAY without BOND and the stay is still there.

The $91M DOLLAR FIGURE IS OUT of this world! Even if they sold your mortgage 48 times the face amount you stated thats only $23m something….How did they ever do this?

How did you obtain all the info on the sales? Was your loan included in numerous trusts? Would you be willing to share so that I can get a feel for how they accomplished the multitude of sales in a pattern that could be applied in my instance?

I can provide a lot of material on the frauds committed by this” KING OF THIEVES” (Deutsche Bank). I am fighting with this thief and the family of Indy Mac. They sold my loan which was $491,250 for more than 48 times in various loan Trusts and made more than 91 Million and I have all the SEC record.

I looked up the investor on our loan and it says just “US Bank Trustee”. They are suing us solely in their capacity as Trustee for the certificate holders of FFMLT 2006FF14. Sigh…any of those sound like a creditor???
