    -I have heard that in some cases there was nothing recorded on the satisfaction of one’s prior mortgage (during a refi) and that that note was then turned over to the new refi loan originator. I suppose via some endorsement….but then I don’t know how any additional loan amounts due could have been added.

    I have the same concern as you. World Savings is long gone and there was nothing recorded saying that loan was satisfied.

    Where would that first loan note be right now? Who was responsible for filing the satisfaction with the county recorder?

  2. How about this scenario…

    Current Mortgage executed in 2005 is being foreclosed by Douche Bank as Trustee of NOTHING…which has its own set of frauds…

    In further review of the “Satisfaction of Mortgage” for the previous mortgage executed in 2004 (Satisfaction was created and recorded TWO MONTHS after new mortgage was recorded) AND the original note and mortgage is nowhere to be found and was not returned to us…

    This “Satisfaction of Mortgage” was signed by “Julie Yates” of “T.D. Service Company”. and contains a MERS Min #…

    Multiple other documents have been discovered where “Julie Yates” has apparently worked as a “Robosigner” as well…PHH Corp; MERS; EMC just to name a few…

    Sounds just like DOCX…

    Here is the question…

    If this “satisfaction” for the previous mortgage was fraudulently created and recorded (Julie Yates had NO authority)

    Then technically the previous mortgage is still a valid mortgage/note and the company is LONG gone… and does it take priority over the current mortgage that is being foreclosed (and discharged in Chapter 7)???

    Concerned that the “Note” could come out of the wood work at any time to be enforced since it was not returned…

    Is Deutshce Bank evil? Is it the source of your problem? Assume yes and yes. Now what?

    No one has enough fingers to point to all the wrongdoers, and they are legion. Deal with what is, for what is is worse than most imagine. The Fed gov’t has been an enabler behind all the greedy Wall Street firms/banks, etc, and it continues to fund and protect the wrongdoers, not the ones wronged.

    The greater energy is needed to focus on what to do and how to repond, individually, according to one’s circumstance(s). There may be some common elements, but each case is its own situation and has its own nuances.

    Of great concern, in addition to figuring out how to handle one’s situation, is the courtroom environment and the recognition that not all judges care about someone losing thier home, and it is still business as usual. The originators and local foreclosure mills are
    more pertinent forces with which to deal, via faulty assignments and sloppy paperwork.

    Focus. There is a greater synergy here by positive contributions than by negative venting that solves nothing.

    DEUTSCHE BANK IF IT WAS SO SMART HOW COME IT DID NOT DO THE SIMPLE ANALYSIS OF HOW MUCH MONEY WE WERE MAKING. and if we could really afford the loan.

    a waitress at Dennys who makes $2k to $3k a month cant afford a $2k Mortgage, and was given one.

    what kind of dumbkopf would make a loan like that?

    WHAT THE GERMAN ECONOMIST IS THAT DUMBKOPF?

    A Mechanic making $5K a month cant afford a house with a teaser payment of $2k which jumps to $3.5K in a year after purchas.

    AND OF COURSE BLAME ON THE LEHMAN BROTHERS GOLDMAN SACHS ETC.

  5. Deutsche Bank has assets – but never as a “Trustee”. And, while Deutsche Bank may purchase portfolios of default loans – if they so – it is not in a Trustee capacity.

    Someone has to account for recovery on a mortgage foreclosure – and it cannot be a Trustee.

    The American Homeowner & general public is a victim…Deutsche Bank is player and a major member of the world servitude system.
    Some how Deutsche Bank knowing ; what , when and why they were in this heist , its HIGHLY likely Deutsche Bank knew down to the second WHEN the hammer would fall & collect their profit …this is their domain ; to screw the planet for monetary gain ..

The A MAN I don’t think we need the death camp references here , it’s irrelevant and inflamatory and this is a serious site ,, I don’t want to see people look at it as a site for nut jobs… Deutsche Bank is gaming the system , they’re trying to protect their assetts ,, all perfectly understandable ,, that they’re one of the biggest players isn’t nefarious ,, quite simply they are the strongest economy in Europe and they needed higher yields (particularly since 2002) to support the socialist policies of the EURO-zone so naturally they were the biggest buyer of this junk ,, if Italy was the powerhouse of Europe then their banks would be the ones we’d be dealing with ….. Deutsche Bank is a victim of Lehman/GS/Morgan Stanley et al … they were told that all this paper left them with an insurable interest in addition to the loans being good solid loans that were properly underwritten…

Make sure when you look at the note (copy) the lender sends you and it is endorsed in blank on the back, that it doesn’t have on the front “certified a true and exact copy”…..If it does, this is not the Original that is endorsed in blank. It is the COPY that escrow made and sent to the lender on funding. That “CERTIFIED A TRUE COPY” is stamped on the copy note when they send the original and the copy to lender. WHY would the lender endorse the copy to someone? That is what I discovered.

  12. I love it. Still, in my case, it appears that my note was endorsed in blank and this fact seems to be stumping my atty as the endorsement makes the note a bearer instrument. That fact seems to be death knell in the courts.

    Anyone that shows up with the noter, regardless how they came to “bear” it, has a right to foreclose. According to my atty that is
