Announcing the establishment of the Homeowners Electronic Registration System (HERS) to assist in mortgage negotiations, litigation, foreclosures and modifications. HERS v MERS, Get It?

We are looking for someone to go through the comments and blog posts that give the name of an officer or other person signing any paper involved in the mortgage or foreclosure of property and to create a index using EXCEL or ACCESS cross referencing the state, financial institution, actual employer etc. that was revealed. If you are successful we will set up a subscription site for people to pay for the inquiries and you will receive income from that site.

You must submit your resume and all relevant contact information to ngarfield@msn.com by March 31, 2010. And you must commit to having the project in final form, subject to continuing revisions no later than April 30, 2010. Upon your selection you will receive a check for $100 in advance.

It’s a good idea but you should put a few more requirements for the database. It’s not enough to simply look at the affidavits of indebtedness. Any affidavit filed is worthy of note because if you can establish than any of them were signed by a questionable, including an affidavit by another law firm or attorney verifying the validity of the attorneys fees being sought as reasonable (requirement here in FL to get attorneys fees) then you can through the entire case in doubt.

Example, bad attorney who gets cited personally by a judge or the local bar, any case he’s signed an affidavit in is questionable. I don’t know say “Coucgh”ivd “hack”ern. or the elk.

Finally, there is no such thing as narrowing the focus to filings withing a state. With due respect Ian the person who signs for PA probably also signs for FL, CA and anywhere else that’s not within 100 miles of where they live in MO. However, it’s important to not only note who signs, but when and where. How else could the sign in two different states on the same day? Better be ready to show plane tickets.

  2. I have already begun developing a very similar database system along with a web based front end for searching / indexing / cross referencing assignors, attorny in facts, certificate series, etc.

    I was desigining this for my own purposes but am more than happy to open it up to public access.

    I can only work on this a few hours a week, so it may be another week or so before I have it ready, but I will gladly post the link here when it is complete.

  3. This is a response to Leo II.

    I am in Fl and have been “uncovering” now for two years. I have “uncovered” from MERS training documents a “corporate resolution”. This gives signatory power to any amount of persons (within that particular firm) to sign as VP, Asst Sec, etc of MERS or any bank. The have recently posted that they will be updating these “corporate resolutions” this month.

    I personally found attorneys or secretaries from South Fl foreclosure attorneys’ offices, signing as MERS or bank directors. I see three problems with this. (1) They do not attach the documents that give them signing authority, (2) An in depth audit would expose the ACTUAL transfers dates, which by the way, are NEVER the same as these last minute assignments, and (3) We know that since securitization happens on virtually all loans, the assignments would NEVER be from the originator to the Servicer, or even the Trust.

    It is sometimes comical to see that as we expose issues, they create documents and positions to support those documents, however, they fail miserably in knowing and executing the correct documents. How simple it would be to be truthful.

  4. Question: Would it be beneficial to also record the names of the executives who is attached or signed to the Prospectus of the securitized loans. These can be found within the Exhibit sections of the Prospectus. It’s typically a VP or SVP. Potentially relevant because there is so much evidence in the Prospectus that implicates the Wall Street institutions’ fraudulent business activities.

    This ASSIGNMENT OF MORTGAGE is made and entered into JUNE 28, 2006, from MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., as nominee for DELTA FUNDING CORPORATION, whose address is 3300 SW 34 Avenue, Suite 101, Ocala, FL 34474, its successors and assigns, (“Assignor”) to HSBC BANK USA, N.A., AS INDENTURE TRUSTEE……………

    This “Assignment” was Notarized on DECEMBER 21, 2009. The person “signing” on behalf of MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., ACTING SOLELY AS NOMINEE FOR DELTA FUNDING CORPORATION was Scott Anderson, Vice President. His “signature” is a couple of scribble marks that appear to be SA.

    This ASSIGNMENT OF MORTGAGE document was “Signed, Sealed and Delivered in the Presence of/or Attested by Juan A. Pardo, Assistant Secretary.” Juan’s “signature” appears to be a fish hook looking “J.”

    The Notary stamp names Carla Tinoco. Her “signature” is a connected “CS.” There are no seals on the document.

    This ASSIGNMENT OF MORTGAGE document was prepared by Laura Buxton, Ocwen Loan Servicing. There is an Attorney Code beneath where her name is typed and beneath that are the handwritten initials, in parentheses, of JRS.

    There’s an ALLONGE payable to the same HSBC, “signed” by Juan A. Pardo with the same fish hook “J”, His title at Ocwen on this document is “Manager of Account Management.” Juan’s signature on the ALLONGE is dated December 21, 2009. (Juan has two different job titles on December 21, 2009.) The following appears beneath his signature on the ALLONGE: “The effective date of the allonge is JUNE 28, 2006.”

    The woman who started foreclosurehamlet is from Florida, so it does tend to focus on Florida. But it is by no means meant to be exclusive to Florida. We decided we wanted to compile a list of all signatories to fraudulent documents–assignments, etc.–from all over the country. So yes, contribute your PA info!

  17. The light is at the end of the tunnel for sure. There is too many and I have got a tip from a member of MERS that they are starting to use anyone at a Mortgage Company to be a signing officer as long as the Broker is a member.

    We need to come together to end this.

  18. zurenarrh- I saw that at foreclosurehamlet, seems to be mostly for Florida victims and cases? I didn’t want to clog it up with names from Pa. Although I do have one of Scott Anderson, vp of every financial institution in the US. Judge Schack in NY smelled a rat, ordered him to produce W2s, 1099s for 3 years to show who he actually worked for. Don’t know if he ever showed up, for, in that case, Deutschbank. My case was with Ocwen. Actually, now that I remember it, in Ocwen v. Mers, ocwen stated that he was the only Ocwen rep. authorized to sign anything. All 500,000 foreclosures, millions upon millions of assignments, etc. ALL BY HIMSELF!

This is a great idea, which has been bandied about on various sites with little follow-through- I know everyone is busy, but; it will take someone with some computer acumen (that’s not me, sorry) to set this up. Could it be done by mortgage broker, which state the mortgaged property is in, “lender”, including name changes due to merger, bankruptcy, with names of notaries, MERS signatories, titles at each step of the way? With this information, who did what at which stage of the game, we may be able to find a pattern or answers more quickly. Just a random thought.
